Terms of Service

These Terms of Service ("Terms") govern your use of grw5.com and the services offered by GRW5 (operated by Rogier van Wagtendonk, sole proprietor, Breda, Netherlands). By accessing or using GRW5, you agree to these Terms. If you do not agree, please do not use the platform.

1. Service Description

GRW5 is a founder growth platform that combines personality-driven assessments, business diagnostics, and grounding tools. The platform offers:

• Free tools (email-gated) - the Cognitive Style Scan (entry-level divergent-thinking assessment), the GRW5 business scan (CEO Scorecard), guides published on grw5.com, and a grounding toolkit. These require a valid email address to receive results.
• Big Five Solo (paid, approximately $10) - a full Big Five personality assessment with personalized results and a founder profile snapshot.
• Big Five Team (paid, approximately EUR 149-299) - a team-level Big Five assessment that maps how personality profiles interact within a founding team.
• Strategic advisory (by application) - high-end advisory services (strategic days, fractional advisory) available to a limited number of founders. Access is by invitation or application only.

GRW5 reserves the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

2. Account Registration and Email Verification

Certain features require you to create an account by providing your name and email address. You agree to:

• Provide accurate and complete information
• Keep your login credentials confidential
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activity that occurs under your account

We verify email addresses via a confirmation link sent to the address you provide. Accounts created with invalid or temporary email addresses may be removed without notice.

You must be at least 18 years old to create an account and use paid services.

3. Acceptable Use

You agree not to:

• Scrape, crawl, or systematically extract content or data from GRW5 using automated tools without our prior written consent
• Reverse-engineer, decompile, or attempt to extract source code from any part of the platform
• Use the platform to transmit spam, malware, or any content that is unlawful, harassing, defamatory, or infringes the rights of others
• Attempt to gain unauthorized access to any system, account, or data
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity
• Resell, redistribute, or sublicense access to paid assessments or tools without our written consent
• Use assessment outputs to make employment decisions, psychological diagnoses, or any high-stakes determinations about individuals without appropriate professional oversight

Violations may result in immediate account suspension and, where applicable, legal action.

4. Payments and Refunds

Paid services are processed via Stripe. By purchasing a paid product, you authorize us to charge the stated price at the time of purchase. All prices are shown inclusive of any applicable VAT unless stated otherwise.

Digital products (assessments, reports) are delivered immediately upon payment. Because of the immediate delivery of digital content, refunds are issued at our discretion. If you have a problem with a purchase, contact us at rogier.vwagtendonk@gmail.com and we will do our best to resolve it.

5. Intellectual Property

All content on GRW5 - including guides, assessment frameworks, scoring models, copy, design, and software - is the property of GRW5 / Rogier van Wagtendonk and is protected by Dutch and international intellectual property law.

You retain ownership of any information you input into assessments (your answers, free-text responses). By submitting inputs, you grant GRW5 a limited, non-exclusive license to process that data to deliver your results and improve the platform.

Assessment reports and outputs delivered to you are licensed for your personal use. You may not republish, sell, or publicly distribute assessment outputs without our written consent.

6. Disclaimer of Warranties

GRW5 is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The platform will be uninterrupted, error-free, or free of viruses
• Assessment results will be accurate, complete, or suitable for any particular purpose
• Advice or content on the platform constitutes professional psychological, financial, or legal advice

GRW5 assessments are self-development tools and are not a substitute for professional guidance.

7. Limitation of Liability

To the maximum extent permitted by Dutch law, GRW5 and Rogier van Wagtendonk shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the platform, including but not limited to loss of revenue, loss of data, or business interruption.

Our total liability to you for any claim arising out of or related to these Terms or the services shall not exceed the total fees you have paid to GRW5 in the 12 months preceding the claim.

8. Termination

You may close your account at any time by contacting us. We reserve the right to suspend or terminate your account if you breach these Terms, without prior notice in cases of serious violations.

Upon termination, your access to paid content is revoked. We will retain your data as required by law (see our Privacy Policy) and then delete it upon your verified deletion request.

9. Governing Law

These Terms are governed by the laws of the Netherlands. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

10. Dispute Resolution

In the event of a dispute, we encourage you to first contact us directly at rogier.vwagtendonk@gmail.com so we can attempt to resolve the matter informally.

If an informal resolution is not possible, disputes shall be submitted to the competent court in Breda, Netherlands, unless mandatory consumer protection law in your country of residence grants you the right to bring proceedings in your local courts.

EU consumers may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

11. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before the new terms take effect. Continued use of GRW5 after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the platform.
